Affiliate Terms

01The agreement

These terms are a deal between you and HardStop LLC, a Delaware limited liability company ("HardStop", "we", "us"). They cover the HardStop Affiliate Program (the "Program"). You accept them when you click agree in the Affiliates tab of the HardStop app, or when you finish a FirstPromoter affiliate profile for HardStop. If you promote HardStop for a business, you confirm you are allowed to sign on its behalf.

Where you are also a HardStop member, the HardStop Terms of Service continue to apply to your membership. If the two conflict on a Program matter, these terms win.

02Who can join

• You must be 18 or older and able to make a binding contract.
• You must have a HardStop account in good standing, or be approved by us directly by email.
• You must complete a FirstPromoter affiliate profile with accurate contact, payout and tax details, and keep them accurate.
• We can accept, turn down or remove any affiliate at our discretion, including when your audience, content or methods are not a fit for a product that helps people stop watching porn.

03How referrals are tracked

You receive a unique referral link (and, where offered, a referral code) through FirstPromoter. A referral is credited to you when all of the following are true:

1. The person reached HardStop through your link, or entered your code at checkout, within 30 days of clicking.
2. They are a new HardStop customer. Someone who has held a HardStop subscription or lifetime licence before is not a new customer.
3. Their subscription payment is successfully charged. A free trial, a failed payment or a trial cancelled before its first charge earns nothing.
4. They were not referred by another affiliate more recently. Where links conflict, the last click wins.

FirstPromoter's tracking records are the record of the Program. We will look into any discrepancy you raise within 30 days of the month in question, but we cannot credit referrals that tracking did not capture, for example where cookies were blocked or the link was not used.

04Commission

Prices quoted are HardStop's current prices and may change. Commission is always 30% of what the member actually paid. We may change the rate or duration for future referrals with 30 days' notice by email or in the app. Members you referred before the change keep the rate and duration that applied when they were referred.

05Getting paid

• Approval. A commission is approved 30 days after the member's payment, once the refund window has passed.
• Schedule. Approved commission is paid once a month in the next payout run.
• Minimum. We pay once your approved balance reaches $50 USD. Smaller balances roll over to the following month.
• Method. PayPal, or bank transfer where we are able to support your country. You choose and maintain your payout details in FirstPromoter. We are not responsible for payments sent to details you provided incorrectly, and payout provider fees are yours.
• Currency. All commission is calculated and paid in US dollars.
• Forms first. We cannot send a payout until your FirstPromoter profile is complete, including the required tax form (for example a W-9 or W-8BEN). Balances wait, they are not lost.
• Taxes. You are responsible for any tax on your commission. Where the law requires it, we will report payments made to you.
• Disputes. Raise any payout query within 60 days of the payout date and we will look into it.

06How you may promote HardStop

Share your link with your audience, your clients, your community, your friends: your website, newsletter, podcast, social accounts, videos, groups, and ads that send people to your own content. Use the approved copy, logos and screenshots we provide, and describe HardStop accurately. That's it.

You must not:

• Refer yourself, your household, or an account you control, or pay or otherwise incentivise people to sign up.
• Bid on "HardStop", "tryhardstop" or misspellings of them in paid search, or run ads that appear to come from HardStop.
• Use "HardStop" in a domain name, social handle, app name or email address, or present yourself as HardStop staff.
• Post your link on, or run promotion through, adult or pornographic sites, services or accounts.
• Send unsolicited email or messages, use cookie-stuffing, forced clicks, iframes, link cloaking that hides the destination, or any technique that credits referrals the person did not knowingly make.
• Offer discounts, coupons, cashback or rebates that HardStop has not issued, or list your link on coupon or deal sites.
• Say or imply anything about HardStop that we do not say ourselves: no guaranteed cure, no medical or therapeutic claims, no outcomes beyond what tryhardstop.com states. The Zero Access Guarantee may only be described as it appears on our website.
• Promote HardStop in connection with illegal content, hate, harassment, or anything that would embarrass HardStop or the people it serves.

Disclose the relationship. Wherever you share your link you must make clear that you earn commission, in the way the law where you publish requires (for example "affiliate link" or #ad). This is your responsibility, not ours.

07Brand and content

While you are in the Program we give you a limited, revocable, non-exclusive licence to use the HardStop name, logo and the marketing assets we supply, only to promote HardStop under these terms. Don't alter the logo or combine it with other marks. Content you create stays yours, and you give us permission to re-share it, with credit, to promote the Program. Either of us can withdraw that permission at any time.

08Privacy

Do not collect, store or pass to us any personal information about the people you refer beyond what the tracking link does on its own. Comply with privacy and marketing laws that apply to you, including consent for email and messaging. We handle referral data under the HardStop Privacy Policy and FirstPromoter's own terms. We never give affiliates visibility of what a referred member does with HardStop, and we never see that ourselves either.

09Ending the agreement

• You can leave at any time by emailing support@tryhardstop.com or closing your FirstPromoter profile. Approved commission is paid at the next payout once it reaches the minimum; anything still in the approval window is paid once approved.
• We can end your participation at any time with notice by email. If we end it without you having breached these terms, you are paid the same way as if you had left.
• Breach. If you breach Section 2 or Section 6, we may remove you immediately, reverse the commission connected to the breach, and withhold any unpaid balance. Fraudulent referrals may also be reported to the payout provider and to the authorities.
• On ending, your link stops tracking new referrals and the brand licence ends. Members you referred keep their membership; commission on them stops unless we have told you otherwise in writing.

10The legal part

• Independent. You are an independent contractor. Nothing here makes you our employee, agent or partner, and you cannot make commitments on our behalf. The Program is not exclusive for either of us.
• As is. The Program, FirstPromoter and HardStop are provided as they are. We don't promise any level of clicks, conversions or earnings, or that tracking will be uninterrupted.
• Liability. To the fullest extent the law allows, our total liability to you under the Program is limited to the commission payable to you in the 12 months before the claim, and neither of us is liable to the other for indirect or consequential loss, including lost profits.
• Your promotion, your responsibility. You will indemnify HardStop against claims, losses and costs arising from your promotional activity, your content, or your breach of these terms or of any law.
• Changes. We may update these terms. We'll notify you by email or in the app at least 30 days before a change that reduces your commission; other changes take effect when posted at tryhardstop.com/pages/affiliateterms. Continuing to share your link after a change means you accept it.
• Law. These terms are governed by the laws of the State of Delaware, USA, and any dispute will be heard in the state or federal courts located in Delaware, except where the law of your country gives you rights that cannot be excluded.
• Whole agreement. These terms, the Program page at tryhardstop.com/pages/affiliates and any written approval we give you are the entire agreement about the Program. If a part is unenforceable, the rest stands.
